Website Terms and Conditons of Use

Welcome. These Terms and Conditions of Use (the "Terms") are a contract between you and Zigzag Solutions LLC ("we," "us," or "our"), which publishes children's books and coloring books under the pen name James Cleary and owns www.zigzagsolutionsllc.com (the "Site"). Please read them before using the Site. By visiting the Site, downloading anything from it, or signing up for our email list, you agree to these Terms. If you do not agree, please do not use the Site.
1. What This Site Is
This Site is a catalog of our books. It tells you about the titles, shares articles and updates, and links you to Amazon and other retailers where the books are sold. We do not sell books, take orders, or process payments on this Site. Every purchase you make is with the retailer you buy from, under that retailer's own terms, and we are not part of that transaction.
The Site is written for adults: parents, grandparents, caregivers, teachers, and librarians. It is not designed for children to use on their own, and it has no accounts, comment sections, chat features, or areas where anyone can post content.
James Cleary is a pen name used by Zigzag Solutions LLC. Books published under that name are ours.
2. Who May Use the Site
You may use the Site if you are at least 18 years old, or if you are old enough to enter into a contract in the state where you live. If you are under 18, you may use the Site only with the involvement of a parent, guardian, or teacher, and only that adult may sign up for our email list or send us anything.
Children under 13 may not join our email list or send us any personal information. Section 5 of our Privacy Policy explains what we do if we learn that a child under 13 has given us information.
3. Free Printables and Activity Pages
Some coloring pages, activity sheets, and other materials on the Site are offered as free downloads. Unless a specific page says otherwise, we give you permission to download, print, and copy those materials for personal, family, classroom, library, camp, homeschool, and similar noncommercial use with the children in your care. You may make as many copies as you need for that purpose.
You may not:

sell, rent, or license the materials, or include them in anything you sell, including a workbook, kit, subscription box, or paid membership;

post the files themselves on another website, file sharing service, marketplace, printable directory, or app, whether or not you charge for them (please link to our Site instead);

remove or cover our name, copyright notice, or watermark;

edit, redraw, or make a derivative version of the artwork or text; or
-
use the materials, or any part of the Site, to develop, train, fine tune, or test any artificial intelligence or machine learning system.
Teachers and group leaders may share printed copies with the children and families in their own class or program. Please do not distribute the digital files.
4. Our Content and Intellectual Property
Everything on the Site, including the text, illustrations, characters, book covers, page layouts, photographs, logos, videos, and downloadable files, is owned by us, or is owned by our founder and used by us with permission, and is protected by copyright, trademark, and other laws. Our book titles, series names, character names, the name James Cleary, and our logos are our trademarks. Nothing on the Site gives you a license to use any of it except as expressly stated in these Terms.
You may share links to the Site freely, and you may quote a short passage from an article with credit and a link back. Everything else requires our written permission. Requests go to admin@zigzagsolutionsllc.com.
5. No Scraping, Data Mining, or AI Training
You may not use any robot, spider, scraper, crawler, or other automated tool to access, copy, index, or collect content from the Site, except that we permit standard search engine crawlers that follow the instructions in our robots file. You may not use the Site or any of its content for text or data mining, or to build, train, improve, or evaluate any artificial intelligence or machine learning model or dataset, whether commercial or not.
6. Things You Send Us
The Site has no way to post anything publicly. If you email us or message us on social media with a comment, review, photo, video, testimonial, question, or a child's artwork, you are giving us permission to use it, in whole or in part, on the Site, in our email newsletter, in our books, and on our social media accounts, without payment to you, and to keep using it. You also give us permission to use the first name and city, or the first name and grade or age, that you provide with it.
By sending us something, you confirm that:

it is yours, or you have the right to send it;

it does not infringe anyone's copyright, trademark, privacy, or publicity rights; and
-
if it was made by a child, you are that child's parent or legal guardian and you consent to our use of it.
Please do not send us a child's last name, school name, home address, or any other detail that would identify the child. If you would like us to stop using something you sent, email admin@zigzagsolutionsllc.com and we will stop using it going forward. We may not be able to change materials that have already been printed or distributed.
7. Please Do Not Send Us Story Ideas
We do not accept unsolicited manuscripts, story ideas, character ideas, book concepts, illustrations, or similar submissions, and we ask that you not send them. We work on many projects at the same time and our own work may resemble something you have in mind. If you send us an idea anyway, you agree that we have no obligation of confidentiality to you, that we owe you nothing for it, and that we are free to develop and publish our own material on the same subject.
8. Buying the Books
Our books are sold by Amazon and other retailers. Prices, availability, formats, shipping, taxes, returns, refunds, and customer service for any purchase are handled entirely by the retailer you buy from, under that retailer's terms and privacy policy, not ours. We do not receive your payment information.
Book details on this Site, including descriptions, page counts, formats, cover images, and suggested ages, are provided for information and may not match a retailer's listing or a later printing. If something looks wrong, email admin@zigzagsolutionsllc.com and we will check it.
9. Email Newsletter
When you join our email list, you are agreeing to receive updates about new books, free printables, events, and occasional promotions. Every email includes an unsubscribe link, and you can also email us to be removed. We do not send marketing text messages.
10. Links to Other Websites
The Site links to other websites, including Amazon and other retailers that sell our books. We do not control those sites, we are not responsible for their content, prices, availability, shipping, returns, or privacy practices, and a link is not an endorsement of everything on the linked site. Please read our Disclaimers page for information about affiliate links and paid relationships.
11. Things You Agree Not to Do
You agree not to:

use the Site for any unlawful purpose or in a way that harms a child;

copy, mirror, frame, or resell any part of the Site;

upload a virus or anything else designed to damage or interfere with the Site;

attempt to gain access to any account, server, or system that is not open to the public;

send us anything obscene, harassing, defamatory, hateful, or otherwise inappropriate for a site about children's books; or
-
impersonate anyone or misstate your relationship to a child.
We may block access to the Site at any time if we believe someone is violating these Terms.
12. Copyright Complaints
We publish everything on this Site ourselves, and the Site does not host material posted by users. If you believe something on the Site infringes your copyright, email admin@zigzagsolutionsllc.com with your name and contact information, identification of the work you say was infringed, the page on the Site where the material appears, and a statement of why you believe the use is not authorized. We look into every notice we receive, and we will take the material down if you are right.
13. Accessibility
We want the Site to work for everyone, and we are working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you have trouble using any part of the Site, or need a document in a different format, email admin@zigzagsolutionsllc.com and tell us what you need and how to reach you. We will try to help.
14. Disclaimers
The Site and everything on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not promise that the Site will always be available, error free, or free of viruses, or that the information on it is complete or current. Our books and activity materials are for education and enjoyment, and we do not promise any particular educational, developmental, or academic result. Please also read our Disclaimers page, which is part of these Terms.
Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
15. Limitation of Liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the Site, the materials you download from it, or any purchase you make from a retailer we link to, even if we were told that those damages were possible.
To the fullest extent the law allows, our total liability for any claim relating to the Site or these Terms will not exceed one hundred dollars ($100).
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for personal injury caused by our negligence.
16. Indemnification
You agree to defend, indemnify, and hold us harmless, along with our officers, employees, contractors, and licensors, from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your use of the Site, your breach of these Terms, anything you send us, or your violation of anyone else's rights.
17. If There Is a Dispute
Let's try to solve it directly first. Before filing anything, please email admin@zigzagsolutionsllc.com with a description of the problem and what you would like us to do. Give us thirty (30) days to respond and try to work it out.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any lawsuit relating to the Site or these Terms must be brought in the state or federal courts located in Alameda County, California, and you and we each consent to the jurisdiction of those courts and waive any objection to venue there.
Any claim relating to the Site must be brought within one (1) year after it arises, unless the law requires a longer period.
18. Changes
We may update these Terms as our books and Site change. When we do, we will change the "Last Updated" date at the top. If the change is significant, we will post a notice on the Site or send an email to our list. Your continued use of the Site after a change means you accept the updated Terms.
We may also change, suspend, or discontinue any part of the Site at any time.
19. Other Terms
These Terms, together with our Privacy Policy and Disclaimers page, are the entire agreement between you and us about the Site. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours in connection with a sale of our business, our book catalog, or our assets.
